GoCappadocia: Kapadokya Bilişim Ticaret Limited Şirketi,
Member: Individuals who register on the system via the www.gocappadocia.com website or affiliated mobile applications,
User: Individuals accessing Gocappadocia.com, whether as members or not,
Gocappadocia.com: All mobile applications, social media channels, and primarily the www.gocappadocia.com website managed by Gocappadocia,
Property: Businesses offering accommodation services for booking through Gocappadocia.com.

2. Acceptance of the Agreement

Each User acknowledges and agrees to comply with the Membership and Terms of Use (“Agreement”). These provisions are deemed accepted and effective once the User accesses Gocappadocia.com.

3. Services

Gocappadocia enables properties to list their products and services on Gocappadocia.com and facilitates Users in making reservations, as well as providing related services. In this context, Gocappadocia acts as a broker under the Turkish Code of Obligations and as an intermediary service provider under the Law on the Regulation of Electronic Commerce. The reservation transaction and accommodation service contract are concluded between the User and the Property.

4. Gocappadocia Membership

Each User must enter an email address and password to become a member of Gocappadocia. The member shall create a password using various characters of sufficient length and shall not reuse it for third-party applications. Setting, changing, and protecting the password is entirely the member’s responsibility. Gocappadocia is not liable for any problems or damages arising from these matters.

Users are fully responsible for any comments, opinions, statements, and personal information shared regarding properties via Gocappadocia.com. Users acknowledge that Gocappadocia is not a party to disputes arising from these comments, has full discretion over publishing or not publishing such content, and reserves the right to moderate it.

Members agree not to use threatening, immoral, racist, unlawful, politically inappropriate, or copyright-infringing usernames, photos, or pseudonyms, and not to send messages or comments violating laws or infringing the rights of individuals or institutions. Users agree not to sell any goods or services on Gocappadocia.com, offer sales proposals, or use the platform for advertising or other commercial purposes without explicit permission.

5. Users’ Rights and Obligations

Users warrant that all information provided to Gocappadocia is accurate. They are responsible for any damages arising from incorrect or incomplete information, and Gocappadocia membership may be terminated in such cases. Users are personally responsible for all transactions made through Gocappadocia.com.

Users acknowledge that Gocappadocia is not liable for the misuse or unauthorized sharing of information by the Property, and agree to comply with the Personal Data Protection, Privacy, and Cookie Policies. Users agree not to process, copy, analyze, or download any commercial or personal data outside the purposes stated in this Agreement.

Users shall pay the accommodation fees as announced by the Property on Gocappadocia.com. Reservations are for personal use and not for resale. Cancellation policies may vary per Property, and users are responsible for reading and accepting them. Promotional or discounted prices may have specific restrictions (e.g., no cancellation/refund rights), and it is the User’s responsibility to verify these before booking.

Users are responsible for additional services, food, beverages, personal expenses, and any other services outside the purchased accommodation, paying these directly to the Property.

6. Gocappadocia’s Rights and Obligations

Gocappadocia acts as an intermediary service provider and broker under the Law on the Regulation of Electronic Commerce and the Turkish Code of Obligations. It is not responsible for the provision of services or payment collection for reserved properties. No additional fees are charged to users beyond the Property’s rate.

From the moment a reservation is made, Gocappadocia communicates the reservation details to the Property and sends confirmation emails to the User as an intermediary. Gocappadocia publishes only information provided by the Properties; the Property is solely responsible for the availability and quality of services.

Gocappadocia may contact Users via any communication channel during the reservation process and, with approval, inform them of new services, projects, promotions, or campaigns via email, social media, or SMS. Gocappadocia may share basic contact and credit card information with the Property solely for reservation and payment purposes.

Gocappadocia is not responsible for any problems or damages arising between Users and Properties. Availability is controlled by the Property, not Gocappadocia. All pricing, room features, cancellation, and reservation policies are determined by the Property. Gocappadocia may temporarily suspend or terminate the system without liability. Users violating this Agreement may have access restricted or membership terminated. Gocappadocia may back up or delete content periodically in accordance with legal and privacy regulations.

7. Payment

Regarding personal data in payment services: When payment services process customers’ data, they act as data controllers independent of the seller. Users’ payments are collected directly by the Property. Users may request chargebacks for incorrect or excess charges.

Payments can be made on the accommodation day via bank transfer/EFT to the Property or by entering credit card information on Gocappadocia.com. Gocappadocia does not verify credit card limits or accuracy. If conditions are not met, the Property may apply its announced cancellation policies. Credit card information is stored securely, and the Property is responsible for its security under PCI standards. Users shall not hold Gocappadocia responsible for any payment disputes with the Property.

8. Other Reservation Terms

a. Distance Sales Agreement: By making a reservation, the User acknowledges that they are a party to the distance sales agreement, which forms part of this Agreement together with the pre-information form.

b. Reservation Changes: Users may make changes to reservations within the timeframes specified by the Property. Additional charges may apply based on new rates.

c. User Cancellation: Users may cancel reservations according to the Property’s stated conditions. Fees already paid will be refunded.

d. Property Cancellation: If Users fail to meet reservation conditions (e.g., not showing up), the Property may apply its cancellation policies. No fee will be charged for unavailable reservations, and fees already paid will be refunded.

e. Disputes: Gocappadocia is not responsible for disputes arising between Users and Properties regarding these provisions.

9. Intellectual and Industrial Property

Users acknowledge that all intellectual and industrial property rights for services, software, trademarks, graphics, content, and designs belong to Gocappadocia. Users shall not infringe these rights. Any violation requires compensation for all damages. Gocappadocia owns all rights to collected data and may generate anonymized reports for internal use or share with third parties, with or without compensation.

10. Force Majeure

Any unforeseeable event such as flood, earthquake, fire, riots, war, or government action preventing performance of obligations is considered force majeure. The affected party will be excused, and deadlines extended accordingly.

11. Penal Provisions

If a member engages in activities violating personal data within Gocappadocia systems, the following Turkish Penal Code articles apply:

12. Final Provisions

Disputes shall primarily be resolved under this Agreement, and where no provision exists, Turkish law applies. Nevşehir Courts and Enforcement Offices have exclusive jurisdiction. Users acknowledge that Gocappadocia’s records and computer logs constitute binding, conclusive evidence.

If any provision is unenforceable or invalid, other provisions remain effective. Gocappadocia may amend, add, or modify clauses for technical or legal compliance. Changes take effect on the day of publication.
